#4. Assessment and Recommendation taking into consideration factors of the International Transfer of Offender Act.

Sacha Bond is a 23 year old Canadian Citizen, first offender, serving a 20 year sentence in the State of Florida. On January 31, 2004, Mr. Bond was at an adult bar in Florida and following an altercation with the staff, he was removed by the manager. He returned with a handgun and began swearing at the staff and patrons alike. He pulled the trigger on the handgun four times, while pointing it at four different individuals, however the gun did not fire.

The United States authorities have not yet rendered a final decision of Mr. Bond's request for transfer to Canada. Mr. Bond submitted his application to his country of citizenship pursuant to the Council of Europe Convention. Therefore, we must obtain Canada's decision prior to seeking a foreign decision.

The offender did not leave or remain outside Canada with the intention of abandoning Canada as his place of permanent residence. A community assessment completed with his mother on Sept. 20, 2006 confirms that he still has social and family ties to Canada and that they are willing to offer support in terms of financial support and accommodation.

**"The information obtained to date does not lead us to believe that he would, after the transfer commit an act of terrorism or a criminal organization offence within the meaning of section 2 of the Criminal Code, nor that he would constitute a treat to the security of Canada

The foreign entity or its prison system does not present a serious threat to the offender's security or human rights.

Mr. Bond suffers from severe mental health illness, including bipolar disorder and also has a history of suicide attempts. The court recommended that he receive mental health treatment while in prison. Although a psychiatrist does attend the facility where Mr. Bond is
incarcerated, it is unclear whether he is being seen on a regular basis.

According to Section 3 of the International Transfer of Offender Act,

"the purpose of this Act is to contribute to the administration of justice and the rehabilitation of offenders and their reintegration into the
community by enabling them to serve their sentences in the country of which they
are citizens or nationals."

The transfer of Mr. Bond will facilitate and enhance his eventual reintegration into the community through appropriate programming, including gradual and supervised release under the jurisdiction of the Correctional Service of Canada.

Should a transfer not be granted, Mr. Bond will be deported to Canada and will not be under the jurisdiction of the Correctional Service of Canada and will not be subject to any supervision requirements or restrictions. The United States has not yet determined Mr.Bond's deportation date" ****
